Contractor Privacy Collection Notice

What we collect

Your legal name, email address, gender, date of birth, residential address, ABN, GST registration status, bank account details, super fund details, and tax file number. Stage name is optional. If you agree to an RCTI agreement, we also record the time you agreed, the version of the agreement, and which employer it is with.

Why we collect it

To calculate, record, and submit your super contributions to your nominated fund, to ask your fund to confirm your member details, and to generate a recipient created tax invoice for the employer that engaged you.

Who we disclose it to

• SuperChoice Services Pty Limited (ABN 78 109 509 739), authorised representative of PayClear Services Pty Limited (ABN 93 124 852 320), AFSL 314357, to process and route your super contribution via SuperStream and to pass a member verification request to your fund. The request carries your name, gender, date of birth, residential address, TFN, member number, and contractor reference, together with your employer's business name, ABN, and contact person details. It carries no bank details.
• The employer that engaged you, who can see your name, stage name, email address, ABN, and GST status to confirm your payment and invoice details. They can also see the name of your super fund, its USI (or its ABN if it is a self managed super fund), the last 2 digits of your member number, and the result of the member verification check sent to your fund, to help resolve a problem with your super contribution. They cannot see your TFN. Your bank account details appear on the tax invoice in their accounting software so they can pay you.
• Xero Limited, which receives your name and bank account details on the tax invoice posted to your employer's Xero accounting file. Xero may store and process this data in countries other than Australia, including New Zealand and the United States. See xero.com/au/legal/privacy.
• Resend Inc, which delivers your invite emails, invoice emails, and emails asking you to update your details if a contribution fails. Resend stores account data, email metadata, and logs in the United States.

Your information is not used for any other purpose and is not sold or disclosed to third parties for marketing.

RCTI agreements

If you are registered for GST, we ask you to agree with each employer that engages you that they may issue recipient created tax invoices for your services. We record the time you agreed and which employer. If you are not registered for GST, you receive a Payment Advice, which is not a tax invoice.

If your super fund does not accept a contribution

If your fund does not accept a contribution because of your details, ContriPay emails you the reason in plain words and asks you to update your details. The email names your employer. It does not include your tax file number, bank details, member number, or other personal details. When you update your details, ContriPay checks them with your fund and tells your employer that the contribution is ready to be sent again.

Storage

Your information is stored in Australia on AWS infrastructure in Sydney. Your tax file number, bank account details, and super fund member number are encrypted at rest.

Consequences of not providing your information

If you do not provide your super fund details, your super contribution cannot be processed.
